We understand that unforeseen circumstances can arise. Your engineer will make every effort to keep the scheduled appointment. Should a change be necessary, you'll receive notification at least two hours beforehand. This advance notice allows you to adjust your plans accordingly. We understand that unforeseen circumstances can sometimes prevent access to your property. To ensure a smooth visit for our engineers, please confirm accessibility prior to their arrival. Please be aware that a £50 charge will apply if access is not available or safe. This fee covers the engineer's wasted travel time and resources. We appreciate your understanding and cooperation in this matter.
Portsmouth Gas Heating - Payment Terms & Late Payment Policy
These terms outline the payment requirements for services rendered and goods supplied by Portsmouth Gas Heating ("we", "us", "our") and the process followed in the event of late payments by the customer ("you"). These terms form an integral part of our overall Terms & Conditions.
1. Payment Due Dates
* Unless otherwise specified in writing (e.g., on your signed quotation or a separate written agreement), payment for services rendered and goods supplied by Portsmouth Gas Heating is due upon receipt of the invoice. We expect payment to be arranged promptly once the invoice is received by you.
* For certain projects, deposits or stage payments may be required before work commences or upon reaching specific milestones. These requirements, amounts, and their specific due dates will be clearly detailed in your quotation or agreement and must be adhered to.
* All payments must be made in full Pound Sterling (£GBP). Accepted payment methods are detailed on our invoices. Please use the invoice number as a reference for your payment.
2. Late Payments
* A payment is considered late if it is not received as cleared funds into our nominated bank account by the due date specified (which, unless otherwise stated, is upon receipt of the invoice).
3. Consequences of Late Payment
* Reminders: While we may send payment reminders as a courtesy, it remains your responsibility to ensure payment is made on time according to the agreed terms.
* Statutory Interest: Portsmouth Gas Heating reserves the right to charge interest on any overdue amounts.
* For commercial debts (business-to-business transactions), interest will be charged in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, at the prevailing statutory rate (currently 8% plus the Bank of England base rate).
* For non-commercial customers (residential clients), we reserve the right to charge interest on overdue amounts at a rate of 8% above the prevailing Bank of England base rate.
* Interest will be calculated daily, starting from the date the payment became overdue until the date the full outstanding balance, including all accrued interest and any applicable charges, is paid in full.
* Late Payment Charges & Compensation:
* (Commercial Clients): In addition to interest, we reserve the right to claim fixed sum compensation for the cost of recovering a late commercial debt, as stipulated by the Late Payment of Commercial Debts Regulations 2002 (currently £40 for debts up to £999.99, £70 for debts between £1,000 and £9,999.99, and £100 for debts of £10,000 or more).
* (All Clients): We reserve the right to charge reasonable administration fees directly related to pursuing the overdue payment (e.g., costs associated with preparing and sending formal debt collection communications). We will provide notification if such charges are to be applied.
* Debt Recovery Costs: You agree to indemnify Portsmouth Gas Heating against all reasonable costs and expenses incurred in recovering overdue amounts. This includes, but is not limited to, legal fees (on a solicitor and own client basis), court costs, trace agent fees, and fees charged by debt collection agencies.
* Suspension or Cancellation of Services: We reserve the right, without prejudice to any other rights or remedies, to suspend or cancel any further supply of goods, services, ongoing work (including maintenance or installation), or warranty services until all outstanding payments, including accrued interest and charges, have been settled in full.
* Title Retention (Applicable to Goods Supplied): Legal and beneficial ownership (title) of any goods (e.g., boilers, radiators, parts) supplied by Portsmouth Gas Heating shall not pass to you until payment for those goods has been received in full as cleared funds. In the event of non-payment, we reserve the right to enter your premises during normal business hours, upon reasonable notice, to peacefully recover such goods to which we retain title.
4. Payment Disputes
* If you genuinely dispute any part of an invoice, you must notify us in writing to portsmouthgasheating@gmail.com or send a letter to 15 Westwood, Portsmouth, PO2 9QH within 7 days of receiving the invoice, clearly outlining the specific reasons for the dispute.
* You must pay the undisputed portion of the invoice by the due date.
* Upon resolution of the dispute, any amounts found to be correctly invoiced must be paid immediately, and late payment interest may be applied retrospectively to such amounts if they were withheld without valid cause beyond the original due date.
5. General
* No failure or delay by Portsmouth Gas Heating in exercising any right or remedy provided under these terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.
* These terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
* You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms.
